Dear Treasurer Frydenberg and Minister Birmingham,

I am emailing you today as I am concerned about the Assistant Treasurer's proposed changes to Governance Standard 3 of the Australian Charities and Not-for-profits Commission Regulations 2013.

These proposed changes are a real threat to our democracy. If enacted, these new regulations would mean that charities could be deregistered for even the most minor offences - including blocking a footpath at a public vigil.

Further, the regulations would give the Charities Commissioner the power to shut down a charity if he believes that a minor breach is likely to happen in the future. This would impede a charity's ability to serve and advocate for our communities and add significant administrative red tape.

These proposed changes have been met with appropriate criticism. Notably, the Senate Standing Committee for the Scrutiny of Delegated Legislation, including members of the Liberal Party, unanimously recommended that the regulations be disallowed.

Furthermore, independent modelling by ACIL Allen found that the sector-wide compliance cost for the new ACNC regulations could be up to $150m in the first year alone. That's more than 100 times what the Treasury indicated in their regulatory impact statement.

Even the lower bound estimate of $78m is a staggering cost that the sector can't afford for regulations that achieve no public-policy benefit.

While the Chair of the Scrutiny of Delegated Legislation Committee has indicated she will move a disallowance motion on the 4th sitting day of 2022, Australian charities need greater certainty that these draconian regulations won’t be imposed on the sector.

Dealing with these regulations is a distraction that charities don’t need at this already difficult time.

As such, I strongly urge your government to withdraw the regulations at the earliest possible opportunity.
